These Terms of Service ("Terms") govern your use of popupsnap.com and of every PopupSnap app: Popups, InstaFeed, Product Studio, Lucky Wheel, PopAutomate, Countdown, Product Badges (together, the "Service"), including where an app runs on its own address such as instafeed.popupsnap.com, customizer.popupsnap.com or popautomate.com. The Service is provided by Grovlix LTD, a company registered in England and Wales (company number 17552126), registered address: Suite 2309, 60 Tottenham Court Road, Area 1/1, Fitzrovia, London, W1T 2EW, United Kingdom ("we", "us"). By creating an account, installing an app or using the Service, you agree to these Terms. If you use the Service for a business, you confirm you can bind that business.
The Service
Our apps help online store owners ("merchants") sell more on their own store:
- Popups: popups, sales and review notifications, upsell and cross-sell offers, and forms that collect shoppers' email, WhatsApp or phone number, with reports.
- InstaFeed: shows the merchant's own Instagram and TikTok posts and videos on their store, with products tagged on them.
- Product Studio: lets shoppers personalise a product (name, text, colour or design), preview it before buying, and gives the merchant production-ready files.
- Lucky Wheel: a spin-to-win wheel that gives shoppers coupons or gifts and collects their email or phone number.
- PopAutomate: runs rules the merchant sets, such as scheduled discounts, automatic price changes and publishing or hiding products.
- Countdown: countdown timers for offers, products and landing pages.
- Product Badges: badges and stickers such as "best seller", "new" or "fast shipping" on product images.
Features differ by app, platform and plan, as shown on each app's page and on our pricing page. We are not affiliated with, endorsed by or sponsored by Salla, Zid, Shopify, WooCommerce, Instagram, Meta or TikTok.
Accounts and eligibility
You must be at least 18 years old, or the age of majority where you live, to open an account. You are responsible for the accuracy of your account details, for keeping your login secure and for everything done under your account. Tell us promptly if you suspect unauthorised use.
How you are billed
Apps bought directly from us. If you subscribe on our website or on an app's own site, for example for a WooCommerce store or a website that uses our embed code, sections 4 to 9 apply. Paddle.com sells these subscriptions to you as our reseller and Merchant of Record (see section 5).
Apps installed from an app store. If you install a PopupSnap app from the Salla or Zid app store, or from another platform's app store, that platform sells and bills the subscription. It sets the price, currency, trial and renewal, issues the invoices and decides refunds under its own terms, and you change or cancel the plan in the platform's dashboard. Sections 4 to 9 do not apply to those subscriptions, and Paddle is not involved. For a technical problem with the app itself, contact us and we will help you fix it. InstaFeed for Shopify is in progress and not yet listed on the Shopify App Store. Today you install PopupSnap apps through Salla or Zid, and InstaFeed also through WooCommerce or a website snippet; if a Shopify App Store listing goes live, this paragraph applies to it too.
Plans and prices
Each app has its own plans. The plans, what each includes, the price, the billing period and any applicable taxes are shown on our pricing page and at checkout before you pay. The price shown at checkout is the price you pay. We may change prices; see Price changes.
Payments: Paddle is the Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries for payments and handles returns and refunds. Paddle collects the payment, calculates and remits the applicable sales tax or VAT, and sends your receipt. By purchasing, you also agree to the Paddle Buyer Terms. Payment and refund help is available at paddle.net. We do not receive or store your full card number.
Free trials
Some plans start with a free trial. The length of the trial, and whether a payment method is needed to start it, are shown at checkout. You are not charged during the trial. When the trial ends, your subscription converts to a paid subscription and your payment method is charged the price you chose, unless you cancel before the trial ends. We may limit free trials to one per customer and per app, and may refuse a trial if we reasonably suspect abuse.
Renewal and cancellation
- Paid subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel.
- You can cancel at any time from the subscription management link in the app's dashboard or in your Paddle receipt email, or by contacting us. Cancelling stops future renewals.
- After you cancel, you keep the paid features until the end of the period you already paid for. After that the app moves to its free plan if it has one, or stops working on your store.
- We do not refund the unused part of a billing period, except as set out in our Refund Policy or required by law.
Price changes
We may change prices or plans. We will tell you by email at least 30 days before a change applies to your next renewal. If you do not accept the change, cancel before the renewal date. Prices already paid are not affected.
Refunds
Refunds are covered by our Refund Policy, which forms part of these Terms. In short: for a direct purchase you may ask for a refund of your first payment for an app within 14 days. Your statutory rights as a consumer are not affected.
Acceptable use
You agree to use the Service only for lawful purposes. You must not:
- use the Service to show, collect or send misleading, fraudulent, hateful, sexually explicit or otherwise unlawful content;
- infringe anyone's copyright, trademark, privacy or other rights;
- attempt to bypass limits, probe or disrupt the Service, reverse engineer it, or access another merchant's account or data;
- resell or sublicense the Service without our written permission;
- breach the terms of any platform you connect, including the Salla, Zid, Shopify, WordPress/WooCommerce, Instagram, Meta and TikTok terms that apply to you;
- share your login details with people outside your business.
You must comply with all laws that apply to your store, including consumer-protection, marketing and data-protection laws, and the laws of the Kingdom of Saudi Arabia where your store operates there.
Rules for specific apps
- Popups and Lucky Wheel: if you collect shoppers' contact details, you must tell them what you will send and get any consent your law requires before you send marketing messages. Prizes, coupons and offers you advertise must be honoured.
- Lucky Wheel and other prize promotions: a spin-to-win wheel, draw or giveaway you run with the Service is your promotion. You are responsible for making sure it complies with the promotion, sweepstakes, lottery and consumer-protection laws of the places where you and your shoppers are. That includes any rules or terms you must publish, any disclosure of odds or prizes, any permit or registration required, and giving the prizes you promise. We do not give legal advice and do not check whether your promotion is lawful.
- InstaFeed: connect or display only accounts and content you own or have the right to show. Do not use it to buy, sell or inflate followers, likes or views, or to impersonate another person or brand.
- Product Studio: you are responsible for the products you make from shoppers' designs, and for refusing designs that are unlawful or infringe someone's rights. Check each production file before you produce it.
- PopAutomate: it changes prices, discounts and products in your store exactly as your rules say. Check your rules before a campaign starts; you are responsible for the prices and offers your rules publish.
- Countdown and Product Badges: timers and badges must be true. A countdown must match the real end of the offer, and a badge such as "best seller" must be accurate.
Your content and your shoppers' data
Content you add to the Service (texts, images, designs, posts, product data) remains yours or its owners'. You grant us the limited licence needed to store, process and display it to run the Service for you. For data about your store's shoppers (for example form entries, wheel entries or personalisation designs) you are the controller and we process it on your behalf, as described in our Privacy Policy. You must tell your shoppers about it in your own privacy notice. For Lucky Wheel on Shopify, the Data Processing Agreement forms part of these Terms.
Third-party platforms
The Service depends on third-party platforms and providers. They may change, limit or stop access at any time, which can affect what an app can do. We do not guarantee that any particular integration, post or feature will always be available.
Our intellectual property
The Service, its software, templates, design and branding belong to us and our licensors. We give you a limited, non-exclusive, non-transferable, revocable licence to use the Service under these Terms.
Availability and changes to the Service
We work to keep the Service available but do not promise uninterrupted or error-free operation. We may update, add or remove features. If we remove a paid feature you are paying for directly, we will offer a fair remedy, which can include a refund for the affected period.
Suspension and termination
You can stop using the Service at any time. We may suspend or end your access if you breach these Terms, if required by law or a platform, or if your use puts the Service or others at risk. Where practical we will give notice first. On termination you lose access to your account data after a reasonable period, subject to our Privacy Policy.
Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise any particular increase in sales.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid for the app concerned in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, or your statutory consumer rights.
Governing law
These Terms are governed by the laws of England and Wales. The competent courts of England and Wales have jurisdiction over disputes, without prejudice to the mandatory consumer-protection rules of the country where you live. If you are a consumer in the European Union, you keep the rights and protections of your local law, including the right to bring a claim in your local courts.
Language
These Terms are written in English and translated into Arabic. If the two versions differ, the English version governs.
Changes to these Terms
We may update these Terms. For material changes we will notify you by email or in the dashboard before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
